Eco Star Double Glazing Pty Ltd, a window and door glazing company, has paid a $25,200 infringement notice for calling numbers on the Do Not Call Register without consent.
This follows an investigation by the Australian Communications and Media Authority into consumer complaints about Eco Star’s telemarketing practices. The investigation found that Eco Star had initially obtained consent for its telemarketing activities but that the consent had lapsed for a majority of the numbers called.
‘Telemarketers must be aware that consent given expressly by consumers expires after three months, unless the person has specifically agreed to a longer period,’ said ACMA Chair, Nerida O’Loughlin.
‘The ACMA has been targeting consent-based telemarketing and electronic messaging practices, following high levels of consumer concern. This is one of a number of investigations finalised under the campaign,’ Ms O’Loughlin added.
The penalties for breaching Australia’s telemarketing rules can be serious for businesses. Where businesses are found to be breaking the rules, the ACMA can seek a civil penalty and/or injunctions from the Federal Court; give an infringement notice; accept a court enforceable undertaking; or issue a formal warning.
